Terms of Service

These Terms of Service govern your access to and use of Zorren. Zorren is operated by Ben Collins, ABN 67 688 063 018, trading as Zorren, from New South Wales, Australia. For legal questions, contact legal@zorren.app.

1. Agreement to these Terms

By creating an account, accessing Zorren, or using any part of the service, you agree to these Terms.

If you use Zorren for a business, you confirm that you have authority to accept these Terms on behalf of that business.

These Terms include and incorporate by reference:

If you do not agree to these Terms, you must not use Zorren.

2. What Zorren is

Zorren is a lead capture and email broadcast platform for small businesses.

Zorren may allow you to:

  • collect names and email addresses through a Zorren-hosted capture page;
  • collect mapped form fields from your own website using a Zorren snippet;
  • manage contacts collected for your business;
  • manually add contacts where your plan allows it;
  • import contacts where your plan allows it;
  • create and send commercial email broadcasts to your contacts;
  • schedule broadcasts where your plan allows it;
  • automatically include unsubscribe links and postal address footers in broadcasts;
  • manage unsubscribe, bounce, complaint, and suppression records;
  • view delivery and open reporting;
  • manage billing and account settings.

Zorren is not a cold outreach tool, list rental tool, affiliate marketing platform, political campaigning tool, financial promotion tool, CRM replacement, SMS platform, WhatsApp platform, or general-purpose bulk email infrastructure service.

3. Eligibility and supported countries

You must be at least 18 years old to create or use a Zorren account.

Zorren is currently intended for customers located in Australia, New Zealand, the United Kingdom, Canada, and the United States.

When signing up, you must provide accurate country and business address information.

We may refuse, restrict, suspend, or terminate access if:

  • you are located in an unsupported country;
  • you provide false or misleading account information;
  • your business type is prohibited by these Terms or our Acceptable Use Policy;
  • your use of Zorren creates legal, regulatory, security, deliverability, or platform reputation risk.

You must not use Zorren as an agency, reseller, white-label provider, managed service provider, or multi-client platform unless we agree in writing.

4. Your account responsibilities

You are responsible for your account and anything done through it.

You must:

  • provide accurate business, billing, sender, reply-to, and postal address information;
  • keep your account information up to date;
  • keep your login credentials secure;
  • prevent unauthorised access to your account;
  • ensure anyone using your account complies with these Terms;
  • notify us promptly if you suspect unauthorised access or account misuse.

You must not share your account in a way that avoids plan limits, access controls, or eligibility restrictions.

5. Customer role and responsibility for contacts

You are responsible for the contacts you collect, add, import, store, and email through Zorren.

For contact lists, captured enquiries, broadcast recipients, and related contact activity, you are the data controller or equivalent responsible party. Zorren processes that data on your behalf to provide the service.

You are responsible for:

  • deciding which contacts are added to your account;
  • ensuring you have a lawful basis, permission, consent, or valid relationship to contact each person;
  • keeping records of how and when each contact was collected;
  • ensuring your use of Zorren complies with privacy, spam, consumer protection, marketing, and electronic communications laws that apply to you and your recipients;
  • responding to requests from your contacts where you are legally responsible for doing so.

Zorren does not verify the legal status of each contact you add or email.

6. Contact collection rules

You may use Zorren only to collect or email people who have a genuine connection with your business.

This may include people who have:

  • submitted an enquiry;
  • subscribed to receive updates;
  • booked with your business;
  • purchased from your business;
  • previously engaged with your business;
  • otherwise given valid consent or permission.

You must not use Zorren to collect or email people with no prior relationship to your business.

For forms on your own website, you are responsible for:

  • your form design;
  • your privacy notice;
  • your consent wording;
  • your field mappings;
  • your website's legal compliance;
  • disclosing that submitted information may be processed by Zorren where required.

For Zorren-hosted capture pages, you are responsible for making sure the page and any custom fields are appropriate for your business and lawful for the people submitting the form.

Zorren may let you map an opt-in checkbox from a form on your website. That mapping is an optional recordkeeping aid, not legal approval of your form or contact list. Whether or not you use it, you remain responsible for having and retaining the permission, lawful basis, or relationship required to collect and email each contact.

You must not use Zorren to collect sensitive personal information unless you are legally permitted to do so and accept full responsibility for that collection.

7. Manual contacts and imports

Where manual add or import functionality is available, you may add or import contacts only if you have an existing relationship, lawful basis, permission, or consent to contact those people.

By manually adding or importing a contact, you represent that:

  • the contact has a genuine relationship with your business or has validly consented;
  • you are legally allowed to email that contact;
  • the contact was not purchased, rented, scraped, harvested, or obtained from a third-party list;
  • you can provide evidence of the relationship, permission, or consent if required by law, a regulator, Zorren, or an email infrastructure provider.

You are solely responsible for contacts you manually add or import.

8. Email sending rules

Zorren may be used only to send broadcasts that relate to your own business, services, appointment availability, cancellations, service updates, or business news directly relevant to the original enquiry or customer relationship.

You must not use Zorren for:

  • cold email;
  • purchased, rented, scraped, harvested, or third-party lists;
  • affiliate offers;
  • third-party promotions;
  • lead generation for third parties;
  • political campaigning or fundraising;
  • financial promotions;
  • investment claims;
  • crypto offers;
  • misleading claims;
  • impersonation;
  • spam;
  • harassment;
  • unlawful content;
  • any content or sending practice prohibited by our Acceptable Use Policy.

You are responsible for your broadcast content, subject lines, sender information, claims, links, offers, and compliance with applicable laws.

9. Unsubscribe, footer, and suppression

Every broadcast sent through Zorren includes an unsubscribe link and the postal address saved in your account.

You cannot remove Zorren's required unsubscribe link from broadcasts.

You are responsible for keeping your postal address accurate and lawful to use in commercial email footers.

You must not:

  • remove, obscure, bypass, or interfere with unsubscribe links;
  • attempt to contact unsubscribed, bounced, or complaining contacts through Zorren;
  • re-add suppressed contacts except through a lawful recipient-initiated resubscribe process;
  • use another account, list, or method to bypass suppression;
  • encourage recipients to resubscribe after they have withdrawn consent where doing so would breach applicable law.

Zorren may maintain suppression records to help prevent future sending to unsubscribed, bounced, or complaining recipients.

10. Open tracking and reporting

When enabled, open tracking adds an invisible image to HTML broadcasts and may record which recipient opened a broadcast and when. Open tracking is enabled by default, but you can disable the account default and override it for an individual broadcast before sending.

Open, delivery, bounce, complaint, unsubscribe, and other reporting data is provided for operational insight only.

You acknowledge that reporting data may be inaccurate, delayed, incomplete, blocked, inflated, or affected by email clients, spam filters, image blocking, privacy tools, automatic preloading, recipient settings, and third-party provider behaviour.

Zorren does not guarantee the accuracy of reporting data.

You are responsible for ensuring that your use of open tracking and email analytics complies with laws that apply to you and your recipients. Before enabling it, you must provide all required notices and obtain all required consents or other authority. Your confirmation in onboarding or Settings is a material instruction to Zorren to process open events on your behalf.

11. Prohibited uses

You must not use Zorren for any business, content, list, message, or activity that is unlawful, harmful, deceptive, abusive, high-risk, or damaging to Zorren's platform reputation.

Prohibited uses include:

  • illegal products or services;
  • weapons or weapon sales;
  • adult services;
  • crypto investment schemes;
  • financial promotions or investment claims;
  • multi-level marketing, pyramid schemes, or similar schemes;
  • payday lending;
  • gambling;
  • misleading health, income, financial, or business claims;
  • malware, phishing, credential collection, or deceptive links;
  • impersonation or false sender identity;
  • harassment, threats, hate content, or abuse;
  • suppression bypass;
  • purchased, rented, scraped, harvested, or third-party lists;
  • collecting sensitive personal information without lawful authority;
  • any activity prohibited by our Acceptable Use Policy.

We may update the Acceptable Use Policy from time to time to protect recipients, customers, Zorren, email infrastructure, and platform reputation.

12. Sending risk controls

Zorren may pause, throttle, restrict, disable, or review sending where we believe there is elevated risk.

Risk indicators may include:

  • high bounce rates;
  • high spam complaint rates;
  • high unsubscribe rates;
  • unusual sending patterns;
  • suspected purchased, scraped, or third-party lists;
  • recipient harm;
  • provider warnings;
  • blocklist risk;
  • platform reputation risk;
  • breach of these Terms;
  • breach of the Acceptable Use Policy;
  • legal, regulatory, or security risk.

Risk controls may be manual or automatic.

We are not required to disclose specific operational thresholds. Thresholds may change without notice.

13. Capture page and service restrictions

We may disable or remove a hosted capture page, snippet access, broadcast function, or other feature if we believe it is being used unlawfully, abusively, deceptively, or in a way that creates risk for Zorren, recipients, providers, or other customers.

Where practical, we may restrict sending first while preserving account access. For serious issues, we may suspend the full account immediately.

14. Plans, limits, and feature access

Your access to features depends on your plan.

Plans may include limits on contacts, email sends, scheduling, manual contact add, imports, exports, branding, customisation, and other features.

Free accounts may have restricted access to contact information, including hidden contact email addresses.

If you exceed your plan limits, Zorren may restrict sending, contact capture, contact add, import, export, or other features until your account is within limit or you upgrade.

If you downgrade to a plan with lower limits, your existing contacts are not automatically deleted, but your account may be restricted until your usage fits within the new plan.

We may change plan features, limits, or pricing from time to time. For existing paid customers, we will use reasonable efforts to give notice before material pricing or limit changes take effect.

15. Billing, renewals, and taxes

Paid plans are billed in USD unless stated otherwise at checkout.

Zorren may offer monthly and annual subscriptions.

Subscriptions renew automatically unless cancelled before the renewal date.

Payments are processed by Stripe. Zorren does not store payment card numbers.

If payment fails, we may attempt to retry payment. If payment remains unresolved, we may restrict sending after a second failed payment and downgrade the account to the free plan after 7 days total.

Cancelling a paid subscription takes effect at the end of the current billing period unless stated otherwise.

You are responsible for any taxes, duties, charges, or similar amounts that apply to your use of Zorren. Zorren is not currently registered for GST. We may add GST, VAT, sales tax, or similar taxes in the future where legally required.

16. Refunds

Payments are generally non-refundable.

We do not provide refunds for:

  • change of mind;
  • unused time;
  • failure to cancel before renewal;
  • reduced usage;
  • account suspension caused by your breach;
  • cancellation part-way through a billing period.

This does not limit rights that cannot legally be excluded.

We may provide a refund or credit where required by law or where there has been an obvious billing error, duplicate charge, or incorrect charge.

17. Service availability

Zorren is provided on an "as available" basis.

We do not promise uninterrupted access, specific uptime, or error-free operation.

Zorren may be affected by maintenance, updates, bugs, security issues, provider outages, email infrastructure limits, payment provider issues, authentication provider issues, hosting issues, internet failures, DNS issues, or other disruptions.

Email delivery is not guaranteed. Delivery depends on recipient mail servers, spam filters, email clients, provider rules, sender reputation, recipient settings, and other factors outside Zorren's control.

Scheduled broadcasts are provided on a best-effort basis. A scheduled broadcast that fails may not be retried automatically.

18. Force majeure

Zorren is not liable for any failure or delay in performing its obligations where that failure or delay is caused by circumstances beyond Zorren's reasonable control, including provider outages, infrastructure failures, internet or DNS failures, email service restrictions, payment provider issues, government action, legal or regulatory restrictions, natural events, labour disruption, war, civil unrest, or similar events.

19. Customer content and licence

You retain ownership of your content.

Your content includes your logos, business information, contact lists, form data, broadcast content, links, text, and other material you provide or send through Zorren.

You grant Zorren a limited licence to host, store, process, transmit, display, copy, format, and send your content only as needed to provide, secure, support, and operate Zorren.

You are responsible for your content and confirm that:

  • you have all rights needed to use it with Zorren;
  • it is accurate and lawful;
  • it does not infringe anyone's rights;
  • it complies with these Terms and the Acceptable Use Policy.

20. Data protection

Our Privacy Policy explains how Zorren handles personal information.

Our Data Processing Terms apply where Zorren processes Contact data on your behalf.

For contact lists, captured enquiries, broadcast recipients, and related Contact activity, you are the data controller or equivalent responsible party.

You must comply with all privacy, spam, electronic marketing, consumer protection, and data protection laws that apply to your business, your recipients, your forms, your lists, and your broadcast content.

21. Third-party services

Zorren relies on third-party providers for hosting, database, authentication, email sending, email event notifications, billing, and related infrastructure.

These providers may include Convex, Clerk, AWS SES, AWS SNS, Stripe, Vercel, and other providers listed in our Privacy Policy or Data Processing Terms.

Zorren is not responsible for third-party provider outages, restrictions, errors, delays, policy changes, pricing changes, security incidents, or service changes outside Zorren's reasonable control.

Your use of some third-party-powered features may also be subject to the relevant provider's terms, policies, or technical limits.

22. Suspension and termination

You may cancel your paid subscription through the billing portal where available or by contacting us.

We may suspend, restrict, or terminate your account or access to any feature if:

  • you breach these Terms;
  • you breach the Acceptable Use Policy;
  • you fail to pay fees when due;
  • your account creates legal, regulatory, security, deliverability, or platform reputation risk;
  • your sending causes or may cause excessive bounces, complaints, unsubscribes, blocklisting, or provider issues;
  • you use purchased, rented, scraped, harvested, or third-party lists;
  • you attempt to bypass unsubscribe or suppression systems;
  • you provide false account, country, sender, billing, or address information;
  • we are required or reasonably asked to do so by a provider, regulator, court, law enforcement body, or legal process;
  • continuing to provide the service would create risk for Zorren, recipients, providers, or other customers.

Suspension may apply to sending only, specific features, capture pages, or the whole account.

If your account is suspended or terminated, any scheduled broadcasts that have not yet been sent will not be delivered.

For serious breaches, we may suspend or terminate immediately without prior notice.

For dormant free accounts, we may terminate the account after 12 months of inactivity by giving 30 days' notice to the account email address. If you respond or resume use during the notice period, we may keep the account active.

23. Account deletion and export

Self-serve account deletion is not currently available.

You can request account deletion by contacting legal@zorren.app.

Where export functionality is available on your plan, you should export any data you need before cancelling or deleting your account.

Account deletion is handled according to the retention periods in our Privacy Policy.

We may retain limited information after account deletion where required or reasonably needed for billing, tax, accounting, legal, security, abuse prevention, dispute, suppression, or compliance purposes.

24. Disclaimers

To the maximum extent permitted by law, Zorren is provided without warranties or guarantees except those that cannot legally be excluded.

We do not guarantee that:

  • Zorren will be uninterrupted, error-free, or always available;
  • emails will be delivered, opened, read, clicked, or acted on;
  • broadcasts will avoid spam folders;
  • open, delivery, bounce, complaint, unsubscribe, or reporting data will be accurate;
  • Zorren will generate revenue, bookings, leads, customers, or profit;
  • Zorren will satisfy the legal requirements of every country, industry, or use case;
  • your website forms, consent wording, privacy notices, lists, or broadcasts are legally compliant.

You are responsible for deciding whether Zorren is suitable for your business and legal obligations.

25. Liability

Nothing in these Terms excludes, restricts, or modifies any right, remedy, guarantee, warranty, or liability that cannot legally be excluded, restricted, or modified.

To the maximum extent permitted by law, Zorren is not liable for:

  • indirect, incidental, special, consequential, or punitive loss;
  • lost profits, revenue, goodwill, opportunities, savings, or business;
  • loss, corruption, or deletion of data caused by your conduct or failure to export;
  • failed, delayed, blocked, filtered, or inaccurate email delivery;
  • inaccurate analytics or reporting;
  • third-party provider outages, errors, limits, restrictions, or policy changes;
  • claims arising from your lists, consent practices, form setup, broadcast content, links, offers, or legal compliance failures;
  • unauthorised access caused by your failure to secure your account, devices, website, or credentials.

To the maximum extent permitted by law, Zorren's total liability for all claims relating to the service is limited to:

  • for paid accounts, the amount you paid to Zorren in the 3 months before the event giving rise to the claim; or
  • for free accounts, AUD $100.

26. Indemnity

You indemnify Zorren against claims, losses, damages, liabilities, penalties, costs, and expenses arising from or relating to:

  • your contact lists;
  • your contact collection practices;
  • your consent, lawful basis, or permission failures;
  • your manual contact adds or imports;
  • your broadcast content, links, offers, claims, or subject lines;
  • your website forms, snippet setup, privacy notices, or consent wording;
  • your breach of privacy, spam, electronic marketing, consumer protection, or other laws;
  • your breach of these Terms or the Acceptable Use Policy;
  • your use of purchased, rented, scraped, harvested, or third-party lists;
  • your attempt to bypass unsubscribe, bounce, complaint, or suppression systems;
  • your prohibited use of Zorren;
  • your infringement of another person's rights.

This indemnity applies to the maximum extent permitted by law.

27. Changes to Zorren or these Terms

We may update Zorren, add features, remove features, change providers, change technical limits, or modify the service from time to time.

We may update these Terms from time to time.

If we make material changes, we will take reasonable steps to notify customers, such as by email, dashboard notice, checkout notice, or updating the date at the top of these Terms.

Your continued use of Zorren after changes take effect means you accept the updated Terms.

28. Governing law and disputes

These Terms are governed by the laws of New South Wales, Australia.

The courts of New South Wales, Australia have jurisdiction over disputes relating to these Terms or Zorren.

This clause does not limit any rights you may have under laws that cannot legally be excluded.
